Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Dculus Software (“Dculus”, “we”, “us”). They govern your use of the hosted Dculus Forms service at forms.dculus.com, including the form builder, the public form pages your respondents see, and related APIs (together, the “Service”).

By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm you have authority to bind it, and “you” means that organisation.

Who we are

Dculus Forms is run by Dculus Software, the trading name of its founder, an individual based in India. Dculus Software is not yet a registered company. If we incorporate, the new company will take over these Terms, and we will tell you before that happens.

1. The Service and the open-source software

Dculus Forms is open-source software released under the GNU General Public License v3. Your rights to download, run, modify and redistribute the software come from that licence, not these Terms. These Terms apply only to the hosted Service we operate. If you self-host Dculus Forms, you are the operator of that installation and these Terms do not apply to it.

2. Your account

• You must be at least 18 years old to create an account.
• Give accurate information and keep it up to date.
• Keep your password secure. You are responsible for activity under your account.
• Tell us promptly at [email protected] if you believe your account has been compromised.

3. Plans, billing and cancellation

• Some features require a paid plan. Plan limits and prices are shown on our pricing page.
• Paid plans are billed in advance through our payment processor, Chargebee, and renew automatically at the end of each billing period until cancelled.
• You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access to paid features until then.
• Payments are non-refundable, including for partly used billing periods, except where the law requires otherwise.
• Prices exclude taxes unless stated. You are responsible for applicable taxes.
• We may change prices with at least 30 days’ notice. Changes apply from your next billing period.
• If your usage exceeds your plan’s limits, we may restrict new submissions until the next billing period or until you upgrade.

4. Your content

You keep all rights to the forms you create and the responses you collect (“Your Content”). You grant us a limited licence to host, copy, process and display Your Content only as needed to run, secure and improve the Service and to comply with the law.

You can export your responses at any time. When you delete content or your account, we delete it as described in our Privacy Policy.

5. Data you collect from respondents

When you collect responses, you decide what data to collect and why, and you are the controller of that data. We process it on your behalf. You agree to:

• tell respondents who you are and how you will use their data, with your own privacy notice;
• have a lawful basis for collecting it, including consent where the law requires it;
• not collect payment card numbers, government identity numbers, health data or other sensitive data unless the law allows it and you have appropriate safeguards; and
• respond to respondents’ requests to access or delete their data.

6. Acceptable use

You must not use the Service to:

• collect passwords, payment details or other credentials through deception (phishing), or impersonate any person or organisation;
• send spam or unsolicited messages;
• collect data from children in breach of the law;
• host malware, or content that is illegal, infringing, harassing, hateful or that exploits anyone;
• probe, overload or bypass the security of the Service, or access other customers’ data; or
• resell the Service without our written agreement.

To report a form that breaks these rules, email [email protected]. We may remove content or suspend accounts that break these rules, with or without notice.

7. AI features

The Service includes AI features that generate forms and summarise responses. AI output can be inaccurate or incomplete, so review it before you rely on it. The text you send to an AI feature, and the form or response data needed to answer it, is processed by our AI provider to produce the result. We do not use Your Content to train AI models, and our provider does not either.

8. Availability and changes

We work to keep the Service available and secure, but we do not guarantee it will be uninterrupted or error-free. We may add, change or remove features. If we remove a material feature of a paid plan, we will give you reasonable notice.

9. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or if we must do so to comply with the law or protect the Service or others. Where reasonable, we will give notice and a chance to export Your Content first.

Sections 4, 5 and 10 to 13 survive termination.

10. Disclaimer

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

11. Limitation of liability

To the fullest extent the law allows:

• we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data; and
• our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you have not paid us.

Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You will defend and indemnify us against third-party claims arising from Your Content, your collection of respondent data, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute, unless the law of your country of residence gives you the right to bring a claim locally.

14. Changes to these Terms

We may update these Terms. For material changes we will notify you by email or in the Service at least 30 days before they take effect. If you keep using the Service after that, you accept the updated Terms.
